About These Terms
These Terms of Service (Terms) are an agreement between you and Edventure Web Development Services, a sole proprietorship owned by Mark Anthony Llego, doing business as “NASH Assessment” and “NASH Reviewer” (Edventure, we, or us). They govern your use of the website, practice assessments, and related features (the service). The operator is:
Edventure Web Development Services, doing business as “NASH Assessment” and “NASH Reviewer”Zone 1, Katipunan Street, Brgy. Lawa-an (Pob.)Basey, Samar 6720, Philippinessupport@nash.com.ph0926 021 1602You accept these Terms when you agree to them while creating your account, or by otherwise using the service. If you do not agree, do not create an account or use the service. Your acceptance is an electronic agreement under Republic Act No. 8792, the Electronic Commerce Act of 2000.
These documents form the agreement, and they are read together:
- the price, inclusions, and access period stated in a specific premium offer you accept;
- the Refund Policy;
- these Terms; and
- the Disclaimer.
If they conflict, the earlier item in this list controls for that subject. The Privacy Policy explains how personal data is processed. A right or remedy that Philippine law does not allow to be waived prevails over all of them.
Web development, virtual assistance, and other freelance client projects are governed by their own written proposal or service agreement, subject to applicable law. These Terms do not apply to those projects except where that agreement adopts them.
Use the Reviewer for Practice
The service provides practice assessments, scoring, explanations, performance summaries, and learning history to help you prepare for school leadership assessments. Questions, scoring rules, features, and content may change as the service develops.
Edventure is independent. It is not affiliated with, endorsed by, sponsored by, or officially connected to the Department of Education (DepEd), the Bureau of Human Resource and Organizational Development (BHROD), or the National Educators Academy of the Philippines (NEAP). The service is not the official National Assessment for School Heads (NASH). It does not use, hold, or distribute official or leaked NASH items. Practice scores, benchmarks, and reports do not establish official eligibility or competency, guarantee examination results, or promise employment or promotion. Check official sources for examination requirements and current guidance.
Your Account
The service is for individuals aged 18 or older who can enter into a binding agreement. Provide accurate account details, keep them current, and use only an account you are authorized to control.
Clerk provides account registration and sign-in. Keep your credentials and verification codes private. Your account and any premium access are personal to you and may not be shared, sold, transferred, or used by more than one person unless Edventure agrees in writing. Contact support promptly if you suspect unauthorized access. Responsibility for activity on your account depends on the circumstances and applicable law.
Use the Service Responsibly
You may use the service for lawful, personal, non-commercial study. You must not:
- Access another person’s account or data without authorization, or share your account or credentials.
- Bypass access restrictions, payment requirements, rate limits, or security controls, or probe the service for vulnerabilities without Edventure’s written permission.
- Disrupt the service, distribute malware, or send abusive or automated traffic.
- Copy, scrape, download in bulk, or extract questions, answers, explanations, or reports by any means, including automated tools or artificial-intelligence systems.
- Post, publish, sell, or share questions, answer choices, explanations, or screenshots of them on websites, social media, group chats, review centers, or other channels, or use them to build a competing product, without Edventure’s written permission.
- Obtain, share, or request actual or leaked official examination items, or use the service to cheat in any official assessment.
- Present the service, its content, or your practice results as official, endorsed by DepEd, or proof of eligibility or competency.
- Impersonate another person, submit unlawful, false, abusive, or defamatory material, or disclose another person’s personal data without authority.
Report a security concern privately to support@nash.com.ph with enough detail to investigate, while avoiding unnecessary access to or disclosure of personal data. Good-faith reports made this way will not be treated as a breach of these Terms.
Question Reports & Feedback
You can report a problem with a question you were shown, choosing a reason and optionally adding details. A report includes your account, the exact question version, and the attempt in which you saw it, so administrators can review it. Edventure decides whether and how to change content and does not promise a reply or a particular outcome. Each account may send a limited number of reports per day.
Keep reports factual. Do not include passwords, payment details, or other people’s personal data. Edventure may remove or disregard abusive, false, or irrelevant reports.
You give Edventure a free, non-exclusive, perpetual, worldwide right to use, copy, adapt, and incorporate any suggestion or correction you submit, in reports or otherwise, to improve its content and service, without payment or attribution. This license does not cover your personal data, which remains governed by the Privacy Policy.
Premium Access & Payments
Some assessments require premium access (sometimes called PRO). Before you pay, Edventure will tell you the price, what is included, the access period, accepted payment channels, and the applicable refund conditions. Prices are in Philippine pesos and include any taxes stated in the offer.
Who Can Buy Premium Access
Premium access is for current DepEd personnel and for licensed professional teachers employed by private schools. You confirm that you qualify before access is granted:
- DepEd personnel sign up with their DepEd email address. Without one, you may verify with your DepEd employee number or school ID.
- Private-school teachers verify with their PRC license number and a current school ID or certificate of employment.
Eligibility is checked when you buy. Leaving DepEd or your school later does not end access you already have. Edventure may ask for proof again while your access is active. If your eligibility cannot be verified, no access is granted and your payment is refunded in full, as the Refund Policy explains.
Premium access is a personal license to use the content through the service. It gives you no copy of the content and no right to share, sell, or publish it. It cannot be transferred, resold, or shared with another person, and paying for it does not make you an owner of any content, as the Content & Intellectual Property section explains.
Payment is made through the channels listed in the Refund Policy. Premium access is granted to your account after your payment is verified. The access period runs from the date access is granted, unless your offer states otherwise, and access ends on its stated expiry date. Edventure will issue an invoice or other proof of payment as required by tax regulations.
There is no automatic renewal or recurring charge. Any recurring arrangement requires a separate, clear agreement before it begins.
Purchases are generally non-refundable once premium access is granted. The Refund Policy explains when a refund is available, including payments for access that was never granted, duplicate payments, unused access, and service problems, and it preserves every remedy required by law.
For payment, access, or refund questions, contact support with your account email and payment reference. Never send full card numbers, passwords, or one-time codes.
Content & Intellectual Property
Edventure or its licensors own the service’s software, design, branding, and original learning content, including its questions, answer choices, explanations, scoring rules, and compilations. These are protected by Republic Act No. 8293, the Intellectual Property Code of the Philippines. While your access is valid, you receive a limited, revocable, non-exclusive, non-transferable right to use the content through the service for your personal study. No ownership or other right is transferred, and lawful exceptions such as fair use remain available.
Paying for premium access does not transfer ownership of any content. Premium access is a license to use the content through the service. It is not a sale, assignment, or transfer of the copyright or of any other intellectual property right in the content. Under Sections 180.2 and 181 of Republic Act No. 8293, a copyright is not assigned without a written indication of that intention, and transferring a copy of a work does not transfer its copyright. Edventure or its licensors keep all right, title, and interest in the questions, answer choices, explanations, scoring rules, results reports, and compilations, including the exclusive economic rights under Section 177 to reproduce, adapt or otherwise transform, distribute, publicly display, and communicate them to the public. The questions and explanations are original literary works under Section 172, and the practice sets and question banks are compilations protected under Section 173. This applies whatever you paid, however long your access lasts, and after it ends. All rights not expressly granted in these Terms are reserved.
Copying, scraping, or extracting the content, or posting, selling, or sharing it, infringes Edventure’s copyright and breaches these Terms, whether you do it yourself, through another person, or with automated or artificial-intelligence tools. Edventure records which questions each account is shown and may use those records to trace copied content to its source. If it finds infringement, Edventure may end access immediately without a refund, ask websites, marketplaces, and platforms to remove the copies, and pursue the civil and criminal remedies of the Intellectual Property Code, including injunctions and damages. These rights continue after your access ends.
Content refers to laws, DepEd issuances, and professional standards so you can study them. Those official works belong to their issuing authorities. Edventure cites them for education and claims no ownership of them. Names such as NASH, PPSSH, DepEd, BHROD, and NEAP are used only to describe the subjects you are preparing for.
If you believe content infringes your rights, email support@nash.com.ph with the work concerned, where it appears in the service, your contact details, and the basis of your claim. Edventure will review the notice and remove or correct content where appropriate.
You keep any rights you have in material you submit. Edventure processes it as described in the Privacy Policy and the Question Reports & Feedback section above. These Terms do not allow Edventure to sell or publish your personal data.
Website Articles, Charts & Data
The website’s public pages also carry Edventure’s content: the NASH Reviewer blog, the data reports, their charts and chart data, sample practice items, and the cleaned datasets, code, and documentation published at data.nash.com.ph. Edventure or its licensors own them, and they are protected by Republic Act No. 8293. No Creative Commons or other open license applies to them.
You may read them, download them for your personal study, link to them, and quote them as the next paragraphs allow. Any other use needs Edventure’s written permission first. That includes republishing, redistributing, or adapting them, and reproducing more than those quotations in research, reports, presentations, apps, or training materials. To ask, email support@nash.com.ph saying who you are, what you want to use, and how. Lawful exceptions such as fair use remain available.
You may share a link to any article, and you may quote up to 100 words from one article without asking, if you name the author and NASH Reviewer, give the article’s title, and link to it. This applies on social media, in presentations, and in your own writing. Section 184.1(b) of Republic Act No. 8293 allows quotations only when the source and the author’s name are mentioned, and Section 193.1 gives the author the right to be named. Do not copy or post a whole article or a substantial part of it, as text, screenshots, or images, and do not present it, or a lightly reworded version of it, as your own.
In research, theses, action research, and other academic or professional work, cite every article, chart, or dataset you draw on, with the author, year, title, NASH Reviewer, and the URL. Each article ends with the reference to use. Facts, data, and ideas belong to no one under Section 175, but using Edventure’s wording, analysis, charts, or compilations without citation is plagiarism, and copying them beyond quotation or fair use under Section 185 without permission infringes Edventure’s copyright.
Search engines and artificial-intelligence services may index the public pages, show short excerpts with a link, and use them to train their models. You may not paste, upload, or otherwise feed the articles, charts, or app content into an artificial-intelligence tool to rewrite, paraphrase, translate, or repackage them, or to make other content from them, without written permission.
If you find the content copied without credit or permission, report it to support@nash.com.ph with the link. Edventure may ask the platform or website to remove it and may pursue the remedies in Sections 216 and 217 of Republic Act No. 8293.
Some downloads are built from government data under the source’s own terms. Cleaned files built from DepEd’s machine-ready datasets are distributed under DepEd’s Terms of Use and Fair Use Policy, which require files built on DepEd’s data to carry the same terms and do not allow added restrictions. For those data files, DepEd’s terms apply instead of the permission rule above: credit DepEd, do not suggest that DepEd is involved in or endorses your work, and follow its rules on assessment data. The code and documentation that come with them still need Edventure’s permission. Figures that EDCOM II, DepEd, and other agencies publish belong to them, and you can cite their reports directly.
Until October 30, 2026, the data downloads carried the Creative Commons Attribution 4.0 license, and the blog allowed charts to be shared with credit and a link. Copies received under that license before that date keep it, because it cannot be withdrawn for them, and charts already shared that way may stay where they are. Everything published or downloaded from that date follows this section.
Privacy & Service Providers
The Privacy Policy explains the account, learning, sign-in, report, and analytics data Edventure processes, why, for how long, and your rights under Republic Act No. 10173, the Data Privacy Act of 2012, and its Implementing Rules and Regulations.
Cloudflare provides hosting, database storage, security, and traffic analytics. Clerk provides authentication. Google Analytics measures how the website, the blog, and the practice sets are used. Their services and any external links may have separate terms and privacy notices. Edventure remains responsible for its own obligations to you.
Availability & Changes
Maintenance, network issues, security measures, or provider failures may interrupt access. Edventure does not promise uninterrupted or error-free service. Contact support if an interruption affects your assessment or premium access.
Edventure is not liable for delay or failure caused by events beyond its reasonable control, such as natural disasters, power or telecommunications outages, provider failures, cyberattacks, government action, or epidemics, consistent with Article 1174 of the Civil Code. Edventure will take reasonable steps to restore service and may extend affected premium access.
Edventure may update features and content. A change that materially reduces premium access you already paid for requires reasonable notice and fair handling under your offer and applicable law.
Suspension & Account Closure
Edventure may restrict, suspend, or close access where reasonably necessary to address a breach of these Terms, including copying, scraping, sharing, or selling content; false or misleading eligibility information or documents; unauthorized access; payment fraud or reversal; security threats; or a legal requirement. Where practicable and lawful, you will be told the reason and given an opportunity to respond or fix the issue. Urgent measures, such as suspending access while suspected copying of content is investigated, may take effect immediately.
Edventure may also close an account or end premium access for another reason, such as discontinuing a plan or the service. It will tell you in advance where practicable, and you will receive a prorated refund for the unused part of your access, as the Refund Policy explains.
You may stop using the service at any time and may ask support to close your account or delete your data. Account closure and data retention follow the Privacy Policy. Deleting your account ends its premium access. Premium access is not restored, transferred, or credited to a new account, even one registered with the same email. Refunds after a restriction, suspension, or closure follow the Refund Policy. Ending access does not remove privacy rights or any remedy required by law.
Responsibility & Liability
Use practice content alongside your own study and official guidance. Edventure does not promise a particular examination outcome. Report content or scoring errors so they can be reviewed.
The Disclaimer sets out warranty exclusions and limits on damages and on total liability, to the extent permitted by applicable law. Nothing in these Terms or the Disclaimer excludes or limits liability for fraud, bad faith, willful misconduct, gross negligence, unlawful processing of personal data, or any other liability that Philippine law does not allow to be excluded or limited.
To the extent permitted by law, you will compensate Edventure for losses and reasonable costs, including attorney’s fees awarded by a court, arising from third-party claims caused by your breach of these Terms, such as unauthorized distribution of content or misuse of another person’s data. This does not apply to losses caused by Edventure’s own fault.
Resolve a Concern
Philippine law governs these Terms. Before filing a formal complaint, please email support@nash.com.ph with the issue, your account email or payment reference, and the outcome you seek, so it can be resolved promptly and amicably. Edventure aims to respond within 7 business days.
This step does not limit your rights. You may bring a consumer complaint to the Department of Trade and Industry (DTI) under the Consumer Act of the Philippines and the Internet Transactions Act of 2023, a privacy complaint to the National Privacy Commission, or a case before the proper court. These Terms do not require arbitration or waive any venue the law gives you.
General Terms
- Electronic notices and records: Edventure may send notices to your account email or display them in the service. You agree that electronic notices, records, and signatures have legal effect, and that system records may be used as evidence under the Rules on Electronic Evidence.
- Severability: if a provision is void or unenforceable, the rest of these Terms continue to apply, and that provision is limited to the extent the law allows.
- No waiver: not enforcing a provision immediately does not waive the right to enforce it later.
- Assignment: you may not transfer your rights under these Terms. Edventure may transfer them with the business, with notice to you, without reducing your rights.
- Survival: provisions on content ownership, feedback, liability, payments owed, and dispute resolution continue after your account ends.
- Language: these Terms are written in English. A translation is for convenience; the English text controls to the extent permitted by law.
Updates to These Terms
The date at the top identifies this version. Edventure will give at least 15 days’ notice of material changes by email or in the service before they take effect. Continuing to use the service after that date means you accept the change. If you disagree, stop using the service before the change takes effect and contact support about account closure or remaining premium access. Changes do not apply to a dispute that has already arisen, do not change the conditions of a purchase already made, and do not remove statutory rights.
This version, dated October 31, 2026, states how artificial-intelligence services and tools may use the website’s articles, charts, and app content. The version of October 30, 2026 added the Website Articles, Charts & Data section, which ends open licensing of the website’s charts and downloads, and states that paying for premium access does not transfer ownership of any content. It applies to the website’s articles, charts, and downloads from that date, and to existing accounts from November 14, 2026, after 15 days’ notice. The version of October 11, 2026 added the premium eligibility rules, stronger protection for the content, and prorated refunds when Edventure ends access for another reason.
For the law on personal data, read the official Data Privacy Act of 2012 and its Implementing Rules and Regulations.
